It seems Nestle can't get a break when it comes to their nearly decade-long battle of trying to trademark its Kit Kat shape in the EU.
Judges in the European Court of Appeal dismissed its attempt to have the shape of the four-finger bar trademarked.
The court heard how the chocolate bar wasn't well-enough known in all member states to be granted a trademark.
They've been in a battle with the likes of Cadbury's for the design trademark, as Cadbury has a similar one for a chocolate bar in Norway.
